End User License Agreement (EULA)
This End User License Agreement (the “Agreement”) is a legal and binding agreement between the user (“You” or “Your”) and Exp DSP, for the use of Exp DSP software (the “Software”) within Your digital audio software and computers. By downloading, installing, or using the Software, You agree to be bound by the terms of this Agreement. If You do not agree to the terms herein, please do not download, install, or use the Software.
1. License Grant:
Exp DSP grants You a non-exclusive, non-transferable license to install and use the Software on up to four (4) computers that You personally own, for Your personal or internal business use, subject to the terms of this Agreement.
2. Restrictions:
You may not use the Software on more than one (1) computer at a time. You may not transfer, distribute, or sublicense the Software to any other person without the developer’s explicit permission. You are prohibited from distributing the Software, including but not limited to, distribution on magazine covers or software review websites. No license is granted to redistribute the Software as part of another software program, including video games, DAWs, etc. You may not reverse engineer, decompile, or disassemble the Software. If it is confirmed that you have shared your license key with others or that the license key has leaked on the internet, the license key may be invalidated.
3. Limitation of Liability:
The Software is provided “as is” without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Exp DSP does not warrant that the Software will meet Your requirements or that its operation will be uninterrupted or error-free. In no event shall Exp DSP be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use or inability to use the Software, even if Exp DSP has been advised of the possibility of such damages.
4. Termination:
This Agreement is effective until terminated. You may terminate it at any time by destroying the Software and all copies thereof. This Agreement will terminate immediately without notice from Exp DSP if You fail to comply with any provision of this Agreement. Upon termination, You must destroy all copies of the Software.
5. Miscellaneous:
This Agreement constitutes the entire agreement between the parties with respect to the use of the Software and supersedes all prior or contemporaneous understandings regarding such subject matter. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable in accordance with their terms.
By installing this Software, You agree to use it at Your own risk. The developer cannot be held responsible for any damages caused as a result of its use.
